Terms and conditions for the sale of goods and provision of services

1. General provisions

The seller of goods and provider of services is SIA “MEMORIAL SERVICES EU”, reg. No. 40203214878, Mālu iela 28 k-3, Riga, LV-1058 (hereinafter – the Seller). These Terms apply to the manufacture and sale of monuments and other grave elements, grave cleaning, landscaping, installation and other work and goods ordered. By placing an order, the Client confirms that they have read and agree to these Terms.

2. Order and payment

The content, price and technical specification of the order are determined by the information on the website, the offer, quote, invoice, drawing, sketch, mock-up or other information agreed by the parties. The Client is responsible for the accuracy of the data, dimensions, texts, dates and other order information provided. On receipt of the advance payment or the full amount, the Seller is entitled to begin fulfilling the order, to order or reserve materials, to put the product into production and to include the work in the schedule. Any additional paid work is agreed with the Client.

3. Custom-made goods

Monuments, grave slabs, borders, pedestals, engravings, inscriptions and other products made to the dimensions, drawing, sketch, layout, text or other individual specification provided by the Client are goods made to order or personalised. The right of withdrawal does not apply to such goods in the cases provided for by law. Once the order has been confirmed, changes are possible only by agreement with the Seller and may involve an additional charge.

4. Approval of the drawing and mock-up

By approving a drawing, sketch, layout or order specification, the Client confirms the dimensions, shape, proportions, text, dates, engraving, arrangement of elements and other parameters stated in it. If the finished product conforms to the specification approved by the Client, any later wish of the Client to change the approved parameters shall not be regarded as non-conformity of the goods and shall not be grounds for free remaking, replacement or a refund. This does not limit the Client's statutory rights in the event of actual non-conformity of the goods.

5. Natural stone

Granite and other natural stones can vary in tone, structure, grain, pattern and mineral inclusions. Natural differences in the material compared with a sample, photograph, visualisation or other product shall not be regarded as non-conformity of the goods if they are characteristic of the material concerned and do not affect its intended use.

6. Services and work at the grave

Services are carried out according to the scope of work ordered. Completion times may be affected by the weather, cemetery restrictions, access, delivery of materials and other circumstances beyond the Seller's control. If the actual situation at the grave differs from the information provided by the Client and additional work is needed, this is agreed separately. If the cleaning ordered cannot be carried out because of inaccurate information provided by the Client, and the Client declines the solution offered, the Seller is entitled to retain €30 for the call-out, locating the grave and assessing its condition.

7. Right of withdrawal

The right of withdrawal applies in the cases, within the time limits and in the manner laid down by law. For goods made to order or clearly personalised, the right of withdrawal does not apply in the cases laid down by law. If the Client has asked for the service to begin after the order has been confirmed and paid for, performance of the service may begin immediately. Once the service has been fully performed, the right of withdrawal cannot be exercised if the conditions laid down by law have been met. If the right of withdrawal is exercised after performance of the service has begun, payment for the part of the service already provided is settled in the manner laid down by law.

8. Complaints and liability

The Seller is responsible for ensuring that the goods and services conform to the agreed order and to the requirements of the law. The Client's later wishes to change a previously approved order, or properties characteristic of a natural material, are not considered non-conformity. Complaints are handled in accordance with the procedure laid down in the laws and regulations of the Republic of Latvia.

9. Final provisions

The customer’s personal data are processed in order to fulfil the order, in accordance with the Privacy Policy. These Terms are governed by the laws and regulations of the Republic of Latvia. Each order is subject to the version of the Terms in force at the time the order was placed.
